GENERAL TERMS AND CONDITIONS OF TICKETS OF BON BON ENTERTAINMENT B.V.
Article 1 – Applicability and Definitions
1.1. These General Terms and Conditions for Admission Tickets (“the General Terms”) apply to any legal relationship between BON BON ENTERTAINMENT B.V. (“BON BON”) and the person who orders/purchases an admission ticket for an event organized by BON BON via BON BON or an official sales organization appointed by BON BON for the relevant event (“the customer”) and the visitor of such an event (“the visitor”).
1.2. “Event” refers to (music) performances, concerts, festivals, and/or other manifestations in the broadest sense.
1.3. “Venue” refers to the actual location of the event as well as all areas, rooms, fields, etc., surrounding it, which are part of the complex within which the event takes place.
1.4. The applicability of any general terms and conditions of the customer or the visitor is expressly rejected.
Article 2 – Admission Ticket
2.1. An admission ticket may consist of a document provided by or on behalf of BON BON, or a unique barcode or QR code provided by or on behalf of BON BON.
2.2. The admission ticket is issued once and typically grants access to one person. If it is a group ticket, the admission ticket grants access to the number of people specified on the group ticket.
2.3. The admission ticket is and remains the property of BON BON. The ticket holder is entitled to attend the event. Only the holder of the admission ticket who shows it first at the start of the event will be granted access. BON BON may assume that the holder of the admission ticket is also the entitled party (the customer). BON BON is not required to perform further checks concerning valid admission tickets. The customer is responsible for ensuring that they remain the holder of the admission ticket provided by BON BON or an official sales organization appointed by BON BON.
2.4. From the moment the admission ticket is made available to the customer, the customer bears the risk of loss, theft, damage, or misuse of the ticket.
2.5. Only purchasing through BON BON’s recognized (pre)sales organization or through BON BON guarantees the validity of the admission ticket. The burden of proof in this regard lies with the customer.
2.6. Admission tickets consisting of a barcode or QR code are provided electronically (via email or app). If the customer has chosen to receive the ticket this way, the customer must ensure that the admission ticket can be provided through secure electronic communication. BON BON cannot guarantee the confidentiality or receipt of the admission ticket.
2.7. BON BON reserves the right to set a maximum limit on the number of tickets that can be ordered. The customer must adhere to this limit. BON BON also reserves the right to cancel tickets exceeding the set maximum.
2.8. Admission tickets are non-refundable. The provisions of article 6:230p sub e of the Dutch Civil Code apply to admission tickets. If this option is available, the admission ticket can be offered for resale through a BON BON-designated ticket exchange platform.
Article 3 – Prohibition of Resale, etc.
3.1. The customer is obliged to retain the admission ticket for personal use and is not allowed to sell it, offer it for sale, or provide it for commercial purposes in any way. The only exception to this ban is the resale of tickets via a BON BON-designated ticket exchange platform.
3.2. The customer is prohibited from advertising or making any (other) publicity in connection with the event and its components.
3.3. If the customer provides the ticket free of charge and not for commercial purposes, the customer must impose the same obligations, as outlined in the General Terms, on the person receiving the ticket (the visitor). The customer guarantees to BON BON that the visitor will comply with these obligations. BON BON may decide to sell tickets in a personalized form (i.e., with the ticket holder’s name). In that case, the admission ticket is non-transferable, and only the person whose name is on the ticket will be granted access.
3.4. If the customer fails to comply with the obligations in this article and/or cannot ensure compliance, the customer owes BON BON an immediately payable fine of €10,000 per violation and €5,000 for each day the violation continues, without prejudice to BON BON’s right to claim compliance and/or compensation for any damage suffered.
Article 4 – The Visitor
4.1. The visitor must cooperate with any security checks when entering the event. If the visitor refuses to undergo a search, access to the event may be denied.
4.2. The visitor must possess a valid and undamaged admission ticket before and during the event and while on the venue premises.
4.3. The visitor must provide identification upon request to enable BON BON to comply with legal obligations, including but not limited to preventing the sale of alcohol to minors.
4.4. It is prohibited to bring bags and backpacks into the venue, except for bags no larger than A4 size. BON BON may establish further rules per event.
4.5. Photography, filming, and recording equipment are prohibited at the event venue. If BON BON temporarily stores such equipment, it does not accept any liability for it.
4.6. Glassware, plastic bottles, cans, fireworks, (fire) weapons, dangerous objects, and alcoholic beverages are prohibited. Illegal items will be confiscated and will not be returned.
4.7. Recording the event in any form, including photography, filming, and other sound or video recordings, is prohibited.
4.8. If the visitor leaves the venue, the admission ticket loses its validity.
4.9. The visitor must comply with the regulations and instructions set by BON BON, the venue operators, security personnel, the fire department, and other authorities. If there is a smoking ban, it applies to all forms of smoking, including e-cigarettes.
4.10. BON BON advises visitors under 16 years old to attend events with an adult. BON BON reserves the right to impose a minimum age for specific events, which will be clearly communicated.
Article 5 – BON BON’s Rights
5.1. If the customer or visitor violates any of the provisions in these General Terms, BON BON is entitled to invalidate the admission ticket or deny further access to the event without refund.
5.2. BON BON reserves the right to deny further access or remove a visitor from the event venue if necessary to maintain order and safety.
5.3. If the admission ticket is suspected of being counterfeit, BON BON can deny access to the event without any compensation.
5.4. The artist and BON BON are entitled to make sound and/or video recordings of the event for promotional purposes, and no compensation is due to those recorded.
5.5. BON BON may impose additional (safety) measures for an event, and will inform the customer and visitor in advance.
Article 6 – Cancellation and Rescheduling
6.1. BON BON reserves the right to reschedule or cancel the event due to force majeure, such as illness, artist cancellation, strikes, fire, bad weather, or epidemics.
6.2. If the event is canceled before it starts, BON BON will refund the ticket price, excluding service fees.
6.3. If the event is rescheduled, the admission ticket remains valid for the new date.
6.4. If one or more artists are unable to perform due to force majeure, no refund will be given if other artists perform or the event proceeds as planned.
6.5. Service fees and transaction costs are non-refundable.
Article 7 – Liability of BON BON
7.1. BON BON is liable for direct damage caused by a failure attributed to BON BON, but not for indirect damage, immaterial damage, or damage caused by intentional or gross negligence.
7.2. Entering the venue and attending the event is at the visitor’s own risk, and BON BON is not liable for hearing, vision, or other physical impairments.
7.3. BON BON is not liable for deviations in the event schedule or any damage caused by these deviations.
7.4. BON BON is not liable for the content or execution of the event program, including changes or duration.
7.5. BON BON is not liable for any loss or damage to the admission ticket.
7.6. BON BON is not liable for any health-related damage, including Covid-19, during the event.

Article 9 – Final Provisions
9.1. BON BON is entitled to modify these General Terms and will notify the customer and visitor in advance.
9.2. Dutch law applies to these General Terms and any agreement between BON BON, the customer, or the visitor.
9.3. Any disputes will be settled by the court in Amsterdam, unless the customer or visitor is not acting in the course of their business, in which case they may choose another court.
